I. AGB Privatkunden

geltungsbereich/lieferbereich

für alle geschäftsbeziehungen zwischen der firma kunst&dünger solutions italy gmbh und dem besteller gelten ausschließlich diese allgemeinen geschäftsbedingungen in ihrer zum zeitpunkt der bestellung gültigen fassung, auch wenn sie nicht nochmals ausdrücklich vereinbart werden. widersprechende oder ergänzende bedingungen des auftraggebers (bestellers/käufers) und mündliche vereinbarungen sind nur dann verbindlich, wenn diese von seiten des verkäufers, der firma kunst&dünger solutions italy gmbh, schriftlich bestätigt wurden.

widerruf
der kunde kann seine bestellung widerrufen, indem er unmittelbar nach abschluss der bestellung einen widerruf per e-mail an die firma kunst&dünger solutions italy gmbh sendet. diese bestätigt daraufhin schriftlich die stornierung des auftrages. bei nachvollziehbarer begründung wie z.b. zahlungsverzug oder nichtbezahlung vorhergehender lieferungen ist die kunst&dünger solutions italy gmbh berechtigt, bestellungen zu widerrufen bzw. zu stornieren.

vertragsabschluss

alle angebote sind freibleibend. die ausgewiesenen preise sind bis zu ihrer aktualisierung verbindlich. ein vertrag zwischen der kunst&dünger solutions italy gmbh und dem besteller kommt durch einen auftrag des bestellers per email oder über onlineshop und die damit einhergehende schriftliche auftragsbestätigung durch die kunst&dünger solutions italy gmbh zustande. abbildungen, abmessungen und gewichtsangaben in informations- und werbeunterlagen sind unverbindlich. druckfehler, irrtümer und änderungen bleiben vorbehalten.

Preise
alle preise der angegebenen währung sind freibleibend und verstehen sich ab versandort (ex works) zuzüglich transportkosten sowie der gesetzlichen mehrwertsteuer, sofern vom gesetz nicht anders vorgesehen.

lieferung
die bestellte ware wird innerhalb des mit dem kunden vereinbarten zeitraumes für die abholung versandfertig gestellt. die versandkosten gehen, sofern nicht gesondert vereinbart, immer zu lasten des käufers. transportschäden sind vom käufer/empfänger sofort nach empfang der vertragsgegenstände beim transportunternehmen zu beanstanden und der firma kunst&dünger solutions italy gmbh zu melden. Dies betrifft nur transporte, die von der firma kunst&dünger solutions italy gmbh organisiert wurden. der versand erfolgt auf gefahr des käufers. sollte es vorkommen, dass die vom kunden bestellten produkte nicht oder nur teilweise verfügbar sind, wird dieser davon unverzüglich in kenntnis gesetzt (mittels auftragsbestätigung bzw. direktem kontakt). die firma kunst&dünger solutions italy gmbh behält sich in diesem fall das recht vor, sich vom vertrag zu lösen. ist der kunde mit der bezahlung einer früheren lieferung in verzug, behält sich die firma kunst&dünger solutions italy gmbh das recht vor, lieferungen zurückzuhalten bzw. bestellungen nicht anzunehmen, ohne zum ersatz eines etwa entstehenden schadens verpflichtet zu sein.

eigentumsrecht
kontokorrent-/saldoklausel (geschäftsverbindungsklausel): der verkäufer behält sich das eigentum an der ware vor, bis sämtliche forderungen des verkäufers gegen den käufer aus der geschäftsverbindung einschließlich der künftig entstehenden forderungen auch aus gleichzeitig oder später abgeschlossenen verträgen beglichen sind. das gilt auch dann, wenn einzelne oder sämtliche forderungen des verkäufers in eine laufende rechnung aufgenommen wurden und der saldo gezogen und anerkannt ist.

rückgaberecht
es besteht grundsätzlich die möglichkeit die bestellten gegenstände gegen rückerstattung des bezahlten kaufpreises innerhalb von max. vierzehn tagen nach erhalt der ware zurückzugeben. die ware muss in neuwertigem zustand in der originalverpackung zurückgeschickt werden. die transportkosten der rücksendung gehen, ausser bei produktionsfehlern, zu lasten des käufers. in jedem fall muss die firma kunst&dünger solutions italy gmbh vor der rückgabe bzw. rücksendung der ware schriftlich avisiert werden. sollte es sich um eine spezialanfertigung für den kunden handeln, ist das rückgaberecht ausser kraft. in diesem falle besteht lediglich das austauschrecht für fehlerhafte produkte, wobei die kunst&dünger solutions italy gmbh hat das recht hat von fall zu fall zu entscheiden, ob die fehlerhaften produkte ausgetauscht, nachproduziert oder gutgeschrieben werden. ein über die kostenrückerstattung hinausgehender schadensersatzanspruch besteht nicht.

gewährleistung und haftung
die gewährleistungsfrist beträgt vierundzwanzig monate ab übergabe der ware. offensichtliche mängel sind spätestens zwei wochen nach erhalt der ware schriftlich mitzuteilen. im gewährleistungsfall steht es der firma kunst&dünger solutions italy gmbh frei, den mangel durch reparatur, ersatzlieferung oder rückzahlung bzw. gutschrift des kaufpreises zu beseitigen. ersatzware wird grundsätzlich frei haus geliefert. schlägt die mängelbeseitigung oder ersatzlieferung fehl, so kann der käufer vom vertrag zurücktreten oder eine herabsetzung des kaufpreises verlangen. darüber hinausgehende ansprüche des bestellers, insbesondere schadensersatzansprüche des bestellers, sind ausgeschlossen, soweit der schaden nicht durch die firma kunst&dünger solutions italy gmbh oder ihre erfüllungsgehilfen vorsätzlich oder grob fahrlässig verursacht worden ist

urheberrecht
an angeboten, zeichnungen, mustern, fotos, grafiken und anderen unterlagen behält sich die firma kunst&dünger solutions italy gmbh die urheberrechte vor. sie dürfen dritten nicht ohne schriftliche zustimmung der kunst&dünger solutions italy gmbh zugänglich gemacht werden. bei sonderanfertigungen für den kunden übernimmt der besteller die haftung dafür, dass die kunst&dünger solutions italy gmbh mit der auftragsdurchführung keine rechte dritter (insbesondere eigentums-, urheber- und vervielfältigungsrechte) verletzt.

höhere gewalt
bei höherer gewalt (krieg, naturkatastrophen etc.) ist die kunst&dünger solutions italy gmbh von der leistungspflicht befreit. sollte die hinderung länger als 30 tage dauern, ist der kunde berechtigt, vom vertrag zurückzutreten. weitere schadens- oder sonstige ansprüche sind ausgeschlossen.

produktaktualität
produktabbildungen und -beschreibungen in prospekten und online shop können von aktuell lieferbaren produkten abweichen. die firma kunst&dünger solutions italy gmbh behält sich das recht vor, gleichwertige nachfolgeprodukte zu liefern.

zahlungsbedingungen
es gelten die preise zum zeitpunkt der bestellung. bei kreditkartenzahlung erfolgt die weitergabe der zahlungsinformationen an das kreditinstitut spätestens bei gefahrenübergang. rechnungskürzungen wie nicht vereinbarte skonti, verpackungsabzüge, portoabzüge oder sonstige kürzungen, denen die firma kunst&dünger solutions italy gmbh nicht zugestimmt hat, bleiben als offene posten bestehen und werden eingefordert. bei zahlungsverzug werden mahngebühren und zinsen verrechnet. nach dem verstreichen der mit der 3. mahnung gesetzten zahlungsfrist wird die forderung einem inkassounternehmen bzw. einer rechtsanwaltskanzlei übergeben. bankverbindung: raiffeisenkasse prad am stilfserjoch, ABI 08183, CAB 58440, k/k: 000/3031/00014, IBAN IT 25 X 08183 58440 000303100014

mindestbestellwert
der mindestbestellwert beträgt 25,00€ für waren (ohne transport, service- oder handlingkosten) pro bestellung. bestellungen unter diesem mindestbestellwert werden mit 10,00€ bearbeitungsgebühr belastet.

datenschutz
die zur abwicklung des vertrags erforderlichen personenbezogenen daten werden vom käufer zur verfügung gestellt und von kunst&dünger solutions italy gmbh im rahmen der ordnungsgemäßen erledigung der auftragsabwicklung gespeichert. Kunst&dünger solutions italy gmbh garantiert höchste sicherheitsstandards und verpflichtet sich, die daten des käufers im rahmen der technischen möglichkeiten vor jedem unberechtigten zugriff zu schützen.

schlussbestimmungen
sollte eine oder mehrere regelungen dieser AGBs unwirksam werden, so wird die wirksamkeit der übrigen regelungen nicht berührt. die unwirksame regelung wird durch die einschlägige gesetzliche regelung ersetzt. gerichtsstandort ist bolzano/bozen mit anwendung der italienischen rechtsbestimmungen. rechtsgültigkeit hat die deutschsprachige fassung der AGBs.

eigentumsrecht

rückgaberecht
es besteht grundsätzlich die möglichkeit bestellte waren zurückzugeben. jede rückgabe muss jedoch der firma kunst&dünger solutions italy gmbh angezeigt und von ihr schriftlich genehmigt sein. werden waren ohne ankündigung vom käufer zurückgesandt, behält sich die firma kunst&dünger solutions italy gmbh das recht vor, die annahme zu verweigern. die ware muss in neuwertigem zustand, möglichst original verpackt zurückgeschickt werden. der käufer hat mit ausreichender verpackung dafür zu sorgen, dass die ware während des transports vor möglichen schäden geschützt wird. aus haftungsgründen ist der transport vom käufer zu organisieren und zu bezahlen. die firma kunst&dünger solutions italy gmbh behält sich vor, eine bearbeitungsgebühr einzuheben. bei produktmängeln entscheidet die firma kunst&dünger solutions italy gmbh über die notwendigkeit der rückholung. im falle einer rückholung wg. produktmangel organisiert die firma kunst&dünger solutions italy gmbh den transport und übernimmt die kosten. in jedem fall hat der käufer mit ausreichender verpackung dafür zu sorgen, dass die ware während des transports gut geschützt ist und keine weiteren schäden entstehen. sollte es sich um eine spezialanfertigung für den kunden handeln, ist das rückgaberecht ausser kraft. die kunst&dünger solutions italy gmbh behält sich das recht vor je nach sachlage zu entscheiden ob die fehlerhaften produkte ausgetauscht, nachproduziert oder gutgeschrieben werden. ein darüberhinausgehender schadensersatzanspruch wegen möglicher entgangener aufträge von seiten des kunden besteht grundsätzlich in keinem fall.

gewährleistung und haftung

ambito di applicazione/consegna

tutti i rapporti commerciali tra kunst&dünger solutions italy gmbh e il cliente sono regolati esclusivamente dalle presenti condizioni generali di contratto nella versione valida al momento dell'ordine, anche se non vengono nuovamente concordate in modo esplicito. condizioni contraddittorie o aggiuntive del cliente (cliente/acquirente) e accordi verbali sono vincolanti solo se confermati per iscritto dal venditore, kunst&dünger solutions italy gmbh.

conclusione del contratto
tutte le offerte sono soggette a conferma. i prezzi indicati sono vincolanti fino al loro aggiornamento. il contratto tra kunst&dünger solutions italy gmbh e l'ordinante si conclude con l'ordine effettuato dall'ordinante via e-mail o tramite il negozio online e con la relativa conferma scritta dell'ordine da parte di kunst&dünger solutions italy gmbh. le illustrazioni, le dimensioni e i pesi contenuti nel materiale informativo e pubblicitario non sono vincolanti. sono fatti salvi gli errori tipografici, gli errori e le modifiche.

revoca
il cliente può annullare l'ordine inviando un'e-mail a kunst&dünger solutions italy gmbh subito dopo l'invio dell'ordine. kunst&dünger solutions italy gmbh confermerà quindi per iscritto l'annullamento dell'ordine. kunst&dünger solutions italy gmbh ha il diritto di annullare o revocare gli ordini in caso di motivi comprensibili, quali ritardi di pagamento o mancato pagamento di consegne precedenti.

prezzi
tutti i prezzi nella valuta indicata sono soggetti a variazioni e si intendono franco fabbrica più le spese di trasporto e l'imposta sul valore aggiunto, salvo diversa disposizione di legge.

consegna
la merce ordinata sarà pronta per il ritiro entro il termine concordato con il cliente. se non concordato separatamente, le spese di spedizione sono sempre a carico dell'acquirente. i danni da trasporto devono essere segnalati all'azienda di trasporto dall'acquirente/destinatario immediatamente dopo il ricevimento della merce contrattuale e kunst&dünger solutions italy gmbh deve essere informata del danno. Questo vale solo per i trasporti organizzati da kunst&dünger solutions italy gmbh. la spedizione è a rischio dell'acquirente. se i prodotti ordinati dal cliente non sono disponibili o lo sono solo in parte, il cliente verrà informato immediatamente (tramite conferma d'ordine o contatto diretto). in questo caso, kunst&dünger solutions italy gmbh si riserva il diritto di recedere dal contratto. se il cliente è in ritardo con il pagamento di una consegna precedente, kunst&dünger solutions italy gmbh si riserva il diritto di trattenere le consegne o di non accettare gli ordini senza essere obbligata a risarcire gli eventuali danni subiti.

diritti di proprietà
clausola di conto corrente/bilancio (clausola di obbligo commerciale): il venditore conserva la proprietà della merce fino a quando tutti i crediti del venditore nei confronti dell'acquirente derivanti dal rapporto commerciale, compresi i crediti futuri derivanti da contratti stipulati contemporaneamente o successivamente, non sono stati saldati. questo vale anche se singoli o tutti i crediti del venditore sono stati inclusi in una fattura corrente e il saldo è stato effettuato e riconosciuto.

ritorni
in linea di principio, è possibile restituire gli articoli ordinati entro un massimo di quattordici giorni dal ricevimento della merce in cambio del rimborso del prezzo d'acquisto pagato. la merce deve essere restituita in condizioni pari al nuovo e nell'imballaggio originale. le spese di trasporto della spedizione di ritorno sono a carico dell'acquirente, tranne in caso di difetti di produzione. in ogni caso, la società kunst&dünger solutions italy gmbh deve essere informata per iscritto prima della restituzione o del ritorno della merce. Nel caso in cui la merce sia stata realizzata su misura per il cliente, il diritto di restituzione non si applica. in questo caso, si applica solo il diritto di sostituzione dei prodotti difettosi, in base al quale kunst&dünger solutions italy gmbh ha il diritto di decidere caso per caso se i prodotti difettosi devono essere sostituiti, riprodotti o accreditati. non vi è alcuna richiesta di risarcimento danni oltre al rimborso dei costi.

garanzia e responsabilitá

il periodo di garanzia è di ventiquattro mesi a partire dal trasferimento del rischio della merce (data della bolla di consegna). i difetti evidenti devono essere segnalati per iscritto entro e non oltre due settimane dal ricevimento della merce. in caso di reclamo in garanzia, kunst&dünger solutions italy gmbh è libera di eliminare il difetto mediante riparazione, fornitura sostitutiva o rimborso o accredito del prezzo di acquisto. la merce sostitutiva viene sempre consegnata franco domicilio. se la riparazione del difetto o la fornitura sostitutiva non riesce, l'acquirente può recedere dal contratto o richiedere una riduzione del prezzo d'acquisto. sono escluse ulteriori pretese dell'acquirente, in particolare richieste di risarcimento danni, a meno che il danno non sia stato causato intenzionalmente o per grave negligenza da kunst&dünger solutions italy gmbh o dai suoi agenti ausiliari

kunst&dünger solutions italy gmbh si riserva il diritto d'autore su offerte, disegni, campioni, foto, grafici e altri documenti. non possono essere resi accessibili a terzi senza il consenso scritto di kunst&dünger solutions italy gmbh. in caso di prodotti realizzati su misura per il cliente, quest'ultimo si assume la responsabilità di garantire che kunst&dünger solutions italy gmbh non violi alcun diritto di terzi (in particolare diritti di proprietà, diritti d'autore e diritti di riproduzione) attraverso l'esecuzione dell'ordine.

maggiore violenza

cancellation

all goods are supplied with a twenty-four month guarantee valid from the dispatch date. obvious defects need to be advised in writing to kunst&dünger solutions italy ltd within 14 days after the reception of the goods. in case of guarantee claim, kunst&dünger solutions italy ltd is free to choose if the defect can be resolved by repairing the item, a replacement delivery, a refund or a credit note. replacement deliveries are generally free. should the repairing of defects or the replacement fail to resolve the issue, the buyer is free to withdraw from the contract or to ask for a reduction in the invoiced value. requests by the buyer beyond this, especially compensation for damages, are excluded as long as the damage was not proven to be caused by kunst&dünger solutions italy ltd or contracted third parties.

kunst&dünger solutions italy ltd reserves all copyright on all drawings, samples, pictures, concepts, graphics and any printed or electronically published material. any use of such materials is only possible with the full written agreement of kunst&dünger solutions italy ltd. before publication, either electronic or printed, a final proof must be signed off by an appropriate representative of kunst&dünger solutions italy ltd. in case of custom-made products the buyer needs to assume full liability that kunst&dünger solutions italy ltd is not infringing any rights of third parties such as property reproduction and copyright when manufacturing items on behalf of the buyer.

act of nature beyond control

in case of force marjeure (war, natural disaster etc.) kunst&dünger solutions italy ltd is exempt of its duty to indemnity. in case the delay takes longer than 30 days the buyer is free to withdraw from the contract. further compensation of damage is excluded.

the products supplied may vary from those illustrated in any published media. kunst&dünger solutions italy ltd reserves the right to deliver updated products.
